Importer Consent and Disclaimer [Specimen]

Representing BAY AREA WAGYU, I hereby acknowledge that I have read every single line and paragraph of the CONFIRMATION ORDER and fully understood well and give my unqualified consent and agreement. Further, I’m releasing WAGYU FARMS OF JAPAN from any liability—civil or otherwise—upon airport arrival of goods ordered, due to forces beyond its control such as unforeseen delays, meat spoilage due to improper handling by hired couriers, and similar instances. Further, WFJ responsibility and obligation end with goods arrival at destination airport, and anything beyond is clearly beyond and outside—both explicit and implicit.

I also give my unqualified consent to the following.1) Prices fluctuate along with foreign exchange rates, market supply & demand, airline fuel surcharge, etc.; 2) Price includes Japanese consumption tax of eight (8%) percent, air freight and freight insurance cost; 3) WFJ will exert its best efforts to obtain desired specifics, or the closest available to desired Wagyu cattle (grade, weight, hometown); 4) Buyer has immediate access to all import licenses and FDA permits; 5) Buyer assumes all cost beyond airport arrival (i.e. trucking, cold storage, delivery etc.).; 6) Buyer must sign an informed consent waiver in favour of WFJ; 7) Certain parts can be ordered but must take the entire part; 8) All goods are to be pre-paid by wire transfer to designated WFJ corporate accounts with Mizuho Bank of Tokyo, Japan; 9) For importers’ convenience, WFJ does provide price estimates in a few currencies based on buyer’s locality. However, final payment is accepted ONLY in Japanese yen or US Dollars; 10) WFJ does NOT provide credit on delivery nor free samples as a matter of policy.

 As potential distributor of WFJ products, I hereby commit myself and resources; to protect, preserve and defend the integrity of WFJ. My company shall agree to observe all guidelines and regulations imposed by WFJ on the Distribution Agreement, packaging boxes, posters, leaflets, labels and stickers, as necessary to WFJ global branding. Further, under no circumstances shall my company BAY AREA WAGYU sell or distribute Wagyu slabs that were no longer pinkish fresh, as reputation and integrity are integral to WFJ global policy.
